EB Games Australia will refund Fallout 76 to eligible customers.

Last year, the Australian Competition and Consumer Commission ruled that Australian purchasers of "Fallout 76" are entitled to a refund if they contact ZeniMax for a refund within seven months of its release. "Fallout 76" has just been released, and the company is now in the process of developing a new product that will be released in Australia, In Australia, consumer laws famously protect customers if a product is found to be defective or damaged.

While it is not surprising that international companies may sometimes run afoul of Australian consumer laws, local retailer EB Games has also admitted that it "likely misled consumers about their consumer warranty rights" with respect to the Fallout 76 launch.

According to a statement released by the ACCC today, "Consumers complained to the ACCC that they were advised by EB Games representatives that they were not entitled to a refund after experiencing various glitches in the Fallout 76 game, including server problems and game bugs."

"Retailers must ensure that their employees are trained to ensure that they do not misrepresent to consumers their consumer warranty rights under the Australian Consumer Law, including the right to a refund in certain circumstances," ACCC Commissioner Sarah Court said in a statement.
