Blizzard battles Fox over a cartoon dog named "Diablo".

Blizzard filed an opposition to Fox Media's application to register the "Diablo" trademark. As expected, the company claims that it has held the "Diablo" trademark for some time and that products using the trademark "have enjoyed tremendous commercial success, have won various industry awards, and have received considerable media attention."

The opposition was filed against, inter alia, Fox's two applications using the Diablo name;

according to Blizzard's opposition, Fox's application is for "products related to a television series or other entertainment property," which would apparently be an upcoming animated series called Housebroken. The show is about a group of neighborhood pets and stray animals who share their thoughts and anguish in group therapy sessions, and the little dog is named, you guessed it, "Diablo."

Blizzard clearly has a valid claim to the trademark, and at issue is whether there is sufficient (i.e., too much) similarity between the trademark Blizzard holds and the one filed by Fox; Diablo's filing may seem oddly scattershot but Blizzard uses the term itself quite broadly, "including drinkware, drink coasters, bottle openers, drawstring backpacks, statues, artwork, books and magazines."

As of now, Fox Media has been informed of Blizzard's objections and has 40 days (from April 26, when the notice was sent) to file a response. If you're interested in the show behind this fiasco, "Housebroken" is scheduled to debut on May 31.
