CD Projekt Promises "Strong" Defense Against "Cyberpunk 2077" Second Lawsuit

CD Projekt said it will "take vigorous action to defend itself" against a second class action lawsuit filed against the company over the failed release of "Cyberpunk 2077" last year. The confirmation of the lawsuit came just three weeks after the filing of the first legal claim stemming from the poor state of the game on previous generation consoles.

The studio confirmed the second lawsuit in a regulatory announcement late last week; CD Projekt did not elaborate on the details of that claim, but said that "the claims, including their subject matter and scope," are identical to those filed in December. The Rosen Law Firm's According to a press release, the lawsuit alleges that CD Projekt made "false and/or misleading statements" about Cyberpunk 2077 and failed to disclose that "a vast number of bugs make it virtually unplayable on current generation Xbox or PlayStation systems."

Cyberpunk 2077 received a high rating of 78/100, with the PC version having its wonderful setting "ruined by an onslaught of bugs," but the Xbox One and PlayStation 4 versions were found to be completely different. The console versions performed much worse than the PC versions, forcing Sony, Microsoft, and CD Projekt to issue refunds, and Sony removed the game from the PlayStation Store entirely.

In an apology video released last week, CD Projekt co-founder Marcin Iwinski said that many of the problems players encountered on consoles did not occur during testing. However, according to a recent Bloomberg report, developers were well aware of the problems before release, and major bugs were still being found after the studio announced that Cyberpunk 2077 had "gone gold" in October 2020. In that same video, Iwinski said that CD Projekt was forced to postpone its DLC plans to work on a fix instead.

"We will act vigorously to defend ourselves against such claims," CD Projekt said in its lawsuit notice.
